FRENZY.BIZ Shell Account reserves the right to suspend or cancel a customer's access to any or all services provided by FRENZY.BIZ Shell Account when we decide that the account has been inappropriately used.
IMPORTANT NOTE - FRENZY.BIZ Shell Account has the right to discontinue service, or deny access to anyone who violates our Policies or the terms and conditions shown below WITHOUT WARNING OR PRIOR NOTICE. No refunds of fees paid will be made if account termination is due to violation of the terms outlined below.
FRENZY.BIZ SHELL ACCOUNT WILL NOT BE RESPONSIBLE FOR ANY DAMAGES YOUR BUSINESS MAY SUFFER. FRENZY.BIZ SHELL ACCOUNT MAKES NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED FOR SERVICES WE PROVIDE. FRENZY.BIZ SHELL ACCOUNT DISCLAIMS ANY WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS INCLUDES LOSS OF DATA RESULTING FROM DELAYS, NON-DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY FRENZY.BIZ SHELL ACCOUNT AND ITS EMPLOYEES. FRENZY.BIZ SHELL ACCOUNT RESERVES THE RIGHT TO REVISE ITS POLICIES AT ANY TIME.

FAILURE TO FOLLOW ANY TERM OR CONDITION WILL BE GROUNDS FOR IMMEDIATE ACCOUNT DEACTIVATION.

Privacy Statement
We take our customers privacy very seriously. You are guaranteed 100% privacy. Information such as address, phone, etc. will not be given out. However, we reserve the right to monitor your account. We will also use given information to verify you as the account holder in the event you forgot your password.

Uptime
FRENZY.BIZ Shell Account will make access available to you on a best-effort basis. Service outages can occur over which we have no control. In the event that an outage lasts more than 24 hours, we will, at your request, prorate the applicable portion of your monthly, quarterly, semiannually, or yearly service charge. Although our average system uptime is outstanding, we cannot and will not make any guarantee of any kind regarding the stability or uptime of this service.
FRENZY.BIZ Shell Account endeavors to have the content of your web site available for http access by any party in the world 99.9% of the time.

Payment Policy
Your account will not be activated until we receive your first month's payment. Invoices are to be paid on or by the date on the invoice. Failure to comply will result in your account being terminated. If you then wish to re-signup for the account, all regular sign-up rules and prices will apply. If at any time your account becomes past due or inactive for any reason, we reserve the right to change your rate to match the current prices.

Abuse
Any attempt to undermine or cause harm to a server, or customer, of FRENZY.BIZ Shell Account is strictly prohibited.
FRENZY.BIZ Shell Account will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc.
Any unauthorized use of accounts or computers by a FRENZY.BIZ Shell Account customer, whether or not the attacked account or computer belongs to FRENZY.BIZ Shell Account, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

Server abuse includes but is not limited to the following:

1. CPU/Resource intensive Programs (This includes broadcasting utilities/IRCd servers/Shoutcasts etc.).
2. Denial of Service Attacks.
3. Hacking/cracking of any kind (This includes exploits).
4. Shell account trading.
5. IRC Flooding/Cloning.
6. Usage of xDCC Bots/eMechs/War bots.
7. Storage of Warez/MP3's/Pornographic content, illegal content, copyright infringement, trademark infringement, cracks, software serial numbers, and/or anything else determined by FRENZY.BIZ Shell Account to be unacceptable use of FRENZY.BIZ Shell Account's services.
8. Taking over IRC channels.
9. Holding taken over IRC channels.
10. Bulk emailing, unsolicited emailings, newsgroup spamming.
11. More than one connection to irc per process.
12. Connecting without authorization to the internet from a non-public vhost on FRENZY.BIZ Shell Account.
13. Providing material that is grossly offensive to the Web community including blatant expressions of bigotry, racism, hatred, or profanity.
14. Promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual.
15. Displaying material containing obscene nudity or pornographic material.
16. Displaying material that exploits children under 18 years of age.
17. Acts of copyright infringement including offering pirated computer programs or links to such programs, information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs, or any type of cracker utilities.

FRENZY.BIZ Shell Account will be the sole arbiter as to what constitutes as a violation of server abuse, and reserve the right to terminate the account without notification.

Intellectual Property Rights
Material accessible to you through FRENZY.BIZ Shell Account's services may be subject to protection under the United States or other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except when expressly permitted by the owner of such rights, you must not use FRENZY.BIZ Shell Account or its servers and network in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material, which you access or receive through the FRENZY.BIZ Shell Account network. If you use a domain name in connection with FRENZY.BIZ Shell Account or similar service, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.

CGI Scripts
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning.

Network Security
Customers may not use the FRENZY.BIZ Shell Account network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. FRENZY.BIZ Shell Account will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Account Sharing
Account sharing is not encouraged. Sharing of accounts by more than 2 people may result in termination of your service. Furthermore, if any questions or problems arise and your account was being shared, it is automatically terminated unless stated by an administrator. Sharing on BNC processes is strictly prohibited. Your BNC is just that, YOUR BNC. If you are found with multiple connections to IRC, your account will be terminated.

Electronic Commerce
You will be solely responsible for the development, operation and maintenance of your online store and products and all contents and materials appearing online or on your products, including without limitation (a) the accuracy and appropriateness of content and materials appearing within the store or related to your products, (b) ensuring that the content and materials appearing within the store or related to your products do not violate or infringe upon the rights of any third party, and (c) ensuring that the content and materials appearing within the store or related to your products are not libelous or otherwise illegal. You will be solely responsible for the final calculation and application of shipping and sales tax. You will also be solely responsible for accepting, processing, and filling any customer orders, and for handling any customer inquiries or complaints arising therefrom.

You are also responsible for the security of any customer credit card numbers and related customer information you may access as a result of conducting electronic commerce transactions through your Web Site. You will keep all such information confidential and will use the same degree of care and security as you use with your confidential information.

Static/Dynamic Content Caching
You expressly (i) grant to FRENZY.BIZ Shell Account a license to cache the entirety of your Web Site, including content supplied by third parties, hosted by FRENZY.BIZ Shell Account under this Agreement and (ii) agree that such caching is not an infringement of any of your intellectual property rights or any third party's intellectual property rights.

Domain Name Registration
Customer agrees to pay FRENZY.BIZ Shell Account prior to the effectiveness of the desired domain name registration, the then-current amounts set forth in the FRENZY.BIZ Shell Account price schedule for the initial registration of the domain name and, should Customer choose to renew the registration, subsequent renewals of the registration. All fees are non-refundable, in whole or in part, even if Customer's domain name registration is suspended, cancelled or transferred prior to the end of Customer's then current registration term. FRENZY.BIZ Shell Account reserves the right to change fees, surcharges, renewal fees or to institute new fees at any time, for any reason, at its sole discretion. Customer's requested domain name will not be registered unless and until we receive actual payment of the registration fee, and have confirmed Customer's registration in an email from FRENZY.BIZ Shell Account to the email address indicated in Customer's registration application. In the event of a charge back by a credit card company (or similar action by another payment provider allowed by FRENZY.BIZ Shell Account) in connection with the payments of the registration fee for Customer's domain name registration, Customer agrees and acknowledges that the domain name registration shall be transferred to FRENZY.BIZ Shell Account as the paying entity for that registration to the registry and that we reserve all rights regarding such domain name including, without limitation, the right to make the domain name available to other parties for purchase. FRENZY.BIZ Shell Account will reinstate Customer's domain name registration solely at FRENZY.BIZ Shell Account's discretion, and subject to our receipt of the initial registration or renewal fee and our then-current reinstatement fee.

Early Termination/Cancellation
FRENZY.BIZ Shell Account reserves the right to cancel a customer’s service at any time. If cancellation is caused by customer’s violation of these policies, then no refund is due. Customers may cancel service at any time, but no refund is due. FRENZY.BIZ Shell Account will not offer refunds whatsoever.

Process Limitation
Upon signup, you are prompted to select the amount of processes you would like to purchase for your account. In the event that you over run your limit, you will be fined $10.00 USD per process. Grace will not be given. If this rule is offended multiple times, your account will be terminated. Extra processes may be purchased by contacting hostmaster@frenzy.biz or using the online Control Panel.

Username/Domain Changes
The changing of your username requires that we delete your existing account and re-add a new account, just as if you had signed up all over again. Due to the effort required for this process, a $5.00 setup fee applies to any and all username changes. If you would like to change domain names, a $5.00 setup fee applies to any and all domain name changes.

DoS Policy
If at anytime you are receiving an attack which interrupts normal network and/or server operation, we reserve the right to do what ever is necessary to stop the attack. This includes, but is not limited to, nulling your assigned ip, changing your assigned ip, suspending or removing your account. We hope you will do your best to avoid attacks.

Services Changes
FRENZY.BIZ Shell Account reserves the right to change prices, policies, and configuration of any and all accounts when deemed necessary.

Refund Policy
FRENZY.BIZ Shell Account will not offer refunds whatsoever.

Indemnification
CUSTOMER AGREES THAT IT SHALL DEFEND, INDEMNIFY, SAVE AND HOLD FRENZY.BIZ SHELL ACCOUNT HARMLESS FROM ANY AND ALL DEMANDS, LIABILITIES, LOSSES, COSTS AND CLAIMS, INCLUDING REASONABLE ATTORNEY'S FEES ASSERTED AGAINST FRENZY.BIZ SHELL ACCOUNT, ITS AGENTS, ITS CUSTOMERS, OFFICERS AND EMPLOYEES, THAT MAY ARISE OR RESULT FROM ANY SERVICE PROVIDED OR PERFORMED OR AGREED TO BE PERFORMED OR ANY PRODUCT SOLD BY CUSTOMER, IT'S AGENTS, EMPLOYEES OR ASSIGNS. CUSTOMER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS FRENZY.BIZ SHELL ACCOUNT AGAINST LIABILITIES ARISING OUT OF; (1) ANY INJURY TO PERSON OR PROPERTY CAUSED BY ANY PRODUCTS SOLD OR OTHERWISE DISTRIBUTED IN CONNECTION WITH FRENZY.BIZ SHELL ACCOUNT'S SERVER; (2) ANY MATERIAL SUPPLIED BY CUSTOMER INFRINGING OR ALLEGEDLY INFRINGING ON THE PROPRIETARY RIGHTS OF A THIRD PARTY; ( 3) COPYRIGHT INFRINGEMENT AND (4) ANY DEFECTIVE PRODUCTS SOLD TO CUSTOMER FROM FRENZY.BIZ SHELL ACCOUNT'S SERVER.

Any violations of these policies represent a breach of your contract with us, and your account will be removed from our system without warning.
